I am sincerely satisfied with the perseverance and patience of Emilie Aloe in preventing a group of people from escaping liability. The punishment is God's business, but she handled her part professionally. Crafting a will is undoubtedly an emotional task. It’s a time when you’re called to think about the future and often, what life may be like once you’re gone. It’s completely natural to feel a gamut of sentiments, from sadness to anxiety, perhaps even fear.

If you die in Ontario without a will, the law states that you have died Intestate. More simply put, you have not specified how your property is to be divided and distributed. The Ontario Succession Law Reform Act regulates how to distribute assets and pay debts in this situation.

It’s very important to draft a will to ensure your wishes are respected and your loved ones are protected. Without one, your assets may not be distributed the way you intended, and it could cause unnecessary legal complications for your family.

There are many online “will builder” services that walk you through a self-service process of creating a will and powers of attorney. At first glance, they are simple to use and will be cheaper than hiring a professional wills & estates lawyer.

However, what you “save” in upfront legal fees, you will pay in the time and effort it will take you to properly sign and store your will so that it is legal and valid. 

Further, if you have any complexity to your will such as complex clauses, dual wills for business owners, life insurance trusts, Henson trusts, blended families, and others, an online self-service platform will not be right for you.

Even if you choose to use an online will building service, in order to be legal and valid, your will still needs to be physically signed in the presence of two witnesses. Digital signatures are not recognized.

Your witnesses cannot be beneficiaries of your estate, the spouse of a beneficiary at the time of signing, or a minor. Each witness must also be at least the age of majority and mentally capable.

Practically speaking, this means that after going through the whole will creation process, you need to print the documents and organize a meeting with two unrelated people to serve as witnesses, which is simple to do at a lawyer’s office.

No, a printed, physical copy of your will is the only legal version. A digital copy is not valid. Therefore, once your will is printed and signed correctly, that copy needs to be stored in a safe place where your executor will be able to find it upon your passing.

Once completed, we will store your will securely in our fireproof safe.

After signing your Will, it will be securely stored at our office to maintain validity and if you ever need to make changes. 

Wills should be reviewed every 3 years to account for any significant life changes. Unless you do so first, we will contact you when it’s time for a review.

While your initial consultation is free, you can expect to pay a $300 retainer fee to engage our firm. 

The price of a will starts at $500+HST for an individual, and $800+HST for couples. The final cost of the Will varies on the specific items required for your unique needs (eg. POA’s, trusts etc.). 

You will be provided with a full cost estimate during your consultation.

After signing your Will, it will be securely stored at our office to maintain validity and if you ever need to make changes. 

Wills should be reviewed every 3 years to account for any significant life changes. Unless you do so first, we will contact you when it’s time for a review.
